Terms of Service

These Terms of Service (the “Terms”) form a binding agreement between you (“you”, “user”) and Super Performance Stocks (the “Platform”, “we”, “us”, “our”), an online stock-market education and research platform operated as a sole proprietorship by Ankit Prajapati from B-209, Sai Shivamrut Bldg, Talav Road, Bhayandar East, Thane, Maharashtra 401105, India. They govern your access to and use of our website at superperformancestocks.com, our free and paid courses, content, tools, and any related services (together, the “Services”).

Please read these Terms carefully together with our Disclaimer, Privacy Policy, and Refund Policy, which are incorporated into and form part of this agreement.

1. Acceptance of these Terms

By accessing the Platform, creating an account, purchasing any course or membership, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by the policies referenced above. If you do not agree with any part of these Terms, you must not use the Services.

We may update these Terms from time to time (see Section 16). Your continued use of the Services after any change takes effect constitutes your acceptance of the revised Terms.

2. Eligibility

To use the Services, you must:

• be at least 18 (eighteen) years of age;
• be legally competent to enter into a binding contract under the Indian Contract Act, 1872; and
• provide accurate, current, and complete information when registering and keep it updated.

The Services are intended for users in India and are described in Indian Rupees (INR). If you access the Services from outside India, you do so on your own initiative and are responsible for compliance with applicable local laws.

3. Nature of the Service — Education Only

Super Performance Stocks provides educational and research content about stock-market concepts, with a focus on momentum and growth-stock methods of learning. The Services are made available for learning purposes only.

We are NOT a SEBI-registered Investment Adviser or Research Analyst. Nothing on the Platform — whether free or paid — is investment advice, a recommendation, or a solicitation to buy, sell, or hold any security or financial product. We do not provide tips, buy/sell/hold calls, price targets, model portfolios, profit-and-loss claims, or any assurance or guarantee of returns.

Any securities, stocks, indices, or instruments named anywhere in our content are used solely as historical teaching examples, illustrated with price data that is at least three (3) months old. They are not suggestions to trade and are not reflective of current or future market conditions.

Markets carry risk. All trading and investment decisions are yours alone. Consult a SEBI-registered investment adviser and your own financial, tax, and legal advisers before acting on anything you learn here.

4. Account Registration & Security

Certain parts of the Services require you to create an account. You agree to provide truthful information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account.

• An account and any membership are personal to you and may not be shared, transferred, sold, or used by more than one person.
• You must notify us promptly at support@mymoonshot.in if you suspect any unauthorised use of your account.
• We may suspend or close accounts that we reasonably believe are being shared, compromised, or used in breach of these Terms.

5. Payments, Pricing & Taxes

• All prices for paid courses and memberships are stated in Indian Rupees (INR) and are payable in advance through our authorised payment partners.
• Payments are processed by third-party payment gateways. We do not store your full card, UPI, or bank details; those are handled by the payment processor under its own terms.
• We are not currently registered under GST, as our turnover is below the applicable threshold, and therefore no GST is charged at present. Once we become liable to register, our displayed prices will be inclusive of GST and a valid tax invoice will be issued where required.
• Prices, plans, and the contents of any course or membership may change at any time. Any change will apply to purchases made after the change takes effect and will not alter the price of an order you have already completed.
• Access to paid content is granted only after we receive successful payment confirmation.

Refunds, where available, are governed by our Refund Policy.

6. Intellectual Property

All content forming part of the Services — including videos, lessons, text, slides, worksheets, screeners, checklists, charts, illustrations, graphics, software, and the look and feel of the Platform — is owned by Super Performance Stocks / Ankit Prajapati or our licensors and is protected by Indian and international copyright, trademark, and other intellectual-property laws.

Our teaching framework and its original concept names are our proprietary intellectual property, including (without limitation):

• The Super Performance Method
• Compression Breakout
• Trend Qualifier Checklist
• Growth Leader Screen

Subject to your compliance with these Terms and full payment of any applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the content you have purchased or that is offered free, solely for your own personal, non-commercial learning. You must not:

• copy, reproduce, download (except where a download is expressly offered), republish, distribute, or publicly display any part of the content;
• record, screen-capture, screen-share, stream, or otherwise capture any live session, video, or paid material;
• resell, sub-licence, rent, lend, or share access to any course, membership, or material; or
• use our names, marks, methodology, or concept names to create competing or derivative training, or in any way that suggests endorsement by us.

All rights not expressly granted to you are reserved. Unauthorised use may result in immediate termination of access and may expose you to civil and criminal liability.

7. Acceptable Use & Prohibited Conduct

When using the Services, you agree that you will not:

• use the Services for any unlawful, fraudulent, or harmful purpose;
• attempt to gain unauthorised access to the Platform, its servers, or other users’ accounts, or interfere with the Platform’s security or operation;
• upload or transmit any virus, malware, or harmful code, or scrape, harvest, or data-mine the Platform by automated means;
• impersonate any person, misrepresent your affiliation, or use the Services to harass, abuse, or harm others;
• present yourself as a SEBI-registered adviser/analyst on the basis of our content, or use our material to provide investment advice or tips to others; or
• violate any applicable law or regulation, including securities laws and the Information Technology Act, 2000.

8. No Investment Advice — Your Decisions, Your Risk

You acknowledge and agree that the Services are educational only and that we do not provide investment advice of any kind. Any action you take in the securities markets is taken on your own independent judgement and at your sole risk. You are solely responsible for evaluating, and bear all responsibility and risk for, your trading and investment decisions and their outcomes, including any losses.

Past performance and historical examples are not indicative of future results. We make no representation that any method, concept, or example will be profitable or suitable for your circumstances.

9. Third-Party Tools & Links

The Services may reference, integrate with, or link to third-party websites, brokers, charting tools, data providers, or payment processors. These are provided for convenience and education only. We do not control, endorse, or assume responsibility for any third-party content, products, or services, and your use of them is governed by their own terms and policies. Any dealings you have with third parties are solely between you and that third party.

10. Disclaimers of Warranties

The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Services will be uninterrupted, error-free, secure, or free of defects, or that any content is complete, current, or accurate. Educational content may be simplified for teaching and may not reflect the latest market or regulatory developments.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Super Performance Stocks or Ankit Prajapati be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, trading or investment losses, loss of data, or loss of goodwill, arising out of or relating to your use of (or inability to use) the Services, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the Services or these Terms, whether in contract, tort (including negligence), or otherwise, is limited to the total amount of fees you actually paid to us for the specific course or membership giving rise to the claim during the three (3) months preceding the event that gave rise to the liability. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable Indian law.

12. Indemnity

You agree to indemnify, defend, and hold harmless Super Performance Stocks and Ankit Prajapati from and against any claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use or misuse of the Services; (b) your breach of these Terms or of any applicable law; (c) your infringement of our or any third party’s intellectual-property or other rights; or (d) any trading or investment decision you make.

13. Suspension & Termination

We may suspend, restrict, or terminate your access to the Services, in whole or in part, without prior notice, if we reasonably believe you have breached these Terms, engaged in prohibited conduct, infringed our intellectual property, or created risk or legal exposure for us or other users.

You may stop using the Services at any time. On termination, the licence granted to you ends and you must cease all use of the content. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnity, and governing law — will continue to apply. Termination does not entitle you to any refund except as expressly provided in our Refund Policy.

14. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Services, you consent to the practices described in that policy.

15. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. You agree that the courts at Mumbai / Thane, Maharashtra, India shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, subject to any applicable provisions for mediation or alternative dispute resolution.

16. Changes to these Terms

We may revise these Terms from time to time to reflect changes in our Services, the law, or our business practices. When we do, we will update the “Last updated” date at the top of this page. Material changes may be notified to you by email or through a notice on the Platform. Your continued use of the Services after the revised Terms take effect means you accept them.
